California Energy Commission Adopts
Proposition 39 Guidelines

Today the California Energy Commission (CEC) voted unanimously to adopt the Proposition 39: California Clean Energy Jobs Act – 2013 Program Implementation Guidelines (Guidelines).  The CEC adopted a revised version of the Guidelines, which became available to the public this morning and can be found at the link below.  Per the Guidelines, the CEC will begin to accept submission of Energy Expenditure Plans (EEPs) in January 2014.  The CEC intends to prepare and distribute a program handbook to assist Local Education Agencies (LEAs) with participation and provide clarification on the Guidelines.


Also below is the link to a document developed by CEC that outlines the major changes from the prior version of the Guidelines (November 2013) and the final version adopted today.  One revision to highlight is the addition of language intended to help LEAs understand labor compliance reporting requirements in current law (page 32).  The new language highlights the notification requirements to the Department of Industrial Relations (DIR) for public works contracts, and it specifies the requirement to complete and submit, and subsequently update as needed, the PWC 100 form.


At the hearing, the CEC Commissioners were very complimentary of the work done and challenges faced in coming to this point.  The CEC received over 700 comments on the proposed Guidelines through its stakeholder process.  CEC staff provided a detailed overview of the program’s statute and proposed Guidelines.  Members of the public were afforded the opportunity to make public comment, and while there were many accolades for the effort undertaken, there were also a number of policy and technical considerations identified for further exploration by legislative staff, utilities, school districts and representatives of the education community, and their industry partners.  Per the CEC legal counsel, revisions to the Guidelines may be considered once the CEC begins to receive EEPs and implementation issues are identified.
